Completing your declaration of compliance
You must complete a declaration of compliance to tell The Pensions Regulator (TPR) what you've done to comply with your employer duties.
The deadline for your declaration of compliance will be five months after your automatic enrolment start date. We'll tell you when your declaration of compliance is due. The Pensions Regulator will also write to you.
Key information
- This page explains the process of completing your scheme's first declaration of compliance.
- If you've just completed your cyclical re-enrolment you'll need to complete a re-declaration of compliance instead.
- We'll also cover off some things to remember about the declaration of compliance process.
What do I need to do?
- Use this checklist from TPR (opens in new window) to collect the information you'll need to complete your declaration of compliance.
- Start to complete your declaration of compliance as soon as possible on TPR's website (opens in new window). Don't wait until you've received your assessment information to start.
- We'll provide the information you'll need for your declaration of compliance. We'll create a task on your dashboard when the information is available. Click the link labelled ‘Declaration of compliance’ in this task to access the information.
Important things to note
- The workforce information you’ll need for your declaration will be available six weeks after your automatic enrolment duties start date or, if your scheme uses postponement, on the first pay cut-off date following the end of the postponement period.
- You should only use the information we've provided on the declaration of compliance screen. This is because TPR need to know the information with effect your automatic enrolment duties start date or the last day of your postponement period whichever is applicable.
- Sometimes the information we provide may be different from the number of employees on your dashboard. This is because the figures we provide for your declaration of compliance is a snapshot of your employees on your automatic enrolment duties date or at the end of your postponement period, whichever applies to your scheme.
- We can only provide workforce information once you've assessed your employees following your automatic enrolment duties start date or the end of the postponement period if your scheme has postponement. That could mean there isn't much time between the end of your postponement period and your declaration deadline. If this is the case, it might be a good idea to complete the rest of the declaration while you're waiting for your assessment data.
